Legal Question in Wills and Trusts in Missouri
Breaking a Trust
My father left a rev. living trust which I am executor over it. He had wrote my brother out, said no disbursment to him. There are 4 other children and we want to share the trust money and land with my brother. If the four of us are in agreement to do this, and sign and have this request noterized will we be able to do this?
Could the state come back on us for not honoring our Fathers request?
Thank you for your help in this manner

Re: Breaking a Trust
Sally,
In order for an attorney to provide competent legal answers to your questions it would be necessary in my opinion for the attorney to interview you, read the trust document itself and perhaps conduct some legal research. You are wise to ask questions concerning the legality of your proposed actions, and I believe it would be worth the trouble and modest expense for you to obtain definitive legal advice before taking any action. If you are not already represented by legal counsel, you may call me at 314-727-2822 for a free telephone consultation. Thank you.
