Breaking a Trust

My father left a rev. living trust which I am executor over it. He had wrote my brother out, said no disbursment to him. There are 4 other children and we want to share the trust money and land with my brother. If the four of us are in agreement to do this, and sign and have this request noterized will we be able to do this?

Could the state come back on us for not honoring our Fathers request?
