Legal Question in Wills and Trusts in Missouri
Contesting a will
My sister and I are half sisters of a man's deceased wife. He left his property to his cousin who was 40 years younger--I question this. How can a cousin be 40 years younger. My sister and I were left out of the will. Can we contest the will after 40 years? We just learned of his death.

Re: Contesting a will
In Illinois, the period to contest a will is 6 months after admission of will to probate. Notice of issuance of letters and of admission to will is published. By publication, notice is attributed to everyone.
Also as "half sisters of a man's deceased wife" you are not heirs of the "man"... thus you were not entitled to actual notice of the petition to admit will
Sorry.

Believe it or not, it is not impossible to have a cousin 40 years older or younger than you, it just depends on the situation.
