Legal Question in Wills and Trusts in Missouri
How Court Judgements affect Individuals
What information from a court's judgement is revealed in an individual's personal information? Are these records sealed?
I was co-executor of my father's estate in Missouri, live in Ohio. Due to conflicts with my half sister (also co-executor) we were removed as executors at my request. My half brother had also stepped in (lifelong conflict with half sister) and stated that the estate auction, used to sell Dad's good and HERS) was an example of mismanagement of funds, and part of the reason I asked to step down. The court documents state that because of this, I must use part of my settlement funds to reimburse this new attorney, which I understand.
My question, then, is this information available to the public in any background checks or credit histories, such as those records that a potential new employer will be checking?
Just curious,
KS

Re: How Court Judgements affect Individuals
I am not sure that there is any Judgment against you based upon the facts stated in your question. However, I can tell you that court files, including all pleadings filed therein, are public records and available to any member of the public with certain exceptions such as juvenile court files, paternity suits and the like. I do not know whether a potential employer would go to the trouble of reviewing the court file in your case, but if a Judgment was in fact entered against you, then that might be included in your credit record. I hope that this helps. If I might be of any service to you, please do not hesitate to call me at 314-727-2822.
