Legal Question in Wills and Trusts in Missouri
death
My son (34) died in MO and I live in IL. He had virtually no assets (used furniture, no car, no property) and lots of bills and an overdrawn checking acct. We had to clean out his apt and most stuff went to trash or charity. Do we need to hire an atty in MO for probate, or can we handle this ourselves, or do we even do probate? Thank you for your help.

First of all, I am sorry for your loss. Under the facts as you have stated them, there does not appear to be any need to open a probate estate.

My condolences for the loss of your son.
There are no assets to probate. The creditors have nothing to execute against to collect. Therefore, save your money. It will not be necessary to hire a lawyer.
