Death of a Spouse

Property was purchased via mortgage by husband and wife. Husband dies. Does son of husband (from a previous marriage) have any legal claim to the property or does it go to the surviving wife? If son does have some legal claim to property, is he also responsible for the same proportion of the mortgage?

The answer to your question depends on how the property was titled (joint tenancy or not) and terms of the Will. The best advice is for you to seek the advice of a qualified trust and estate lawyer in the County where this is taking place.
