Legal Question in Wills and Trusts in Missouri

Discovery of father's assets

My father died without a will and there is no surviving spouse but a live in girlfirend for sveral years. My brother and I (his only children) would like to know how we find out what our father owned and owed. There is a business and two residences. His girl friend lives in one house and her son lives in the other. There are also two vehicles. We know there are bank accounts but are not sure what names are on the accounts. The girlfriend has told us that we are not getting anything which is fine if Dad left it all to her but we would like to be sure those were his wishes. She will not produce a will even though our father said he has a will. What can we do to find out what our father's assets are?

Re: Discovery of father's assets

You can file an action in court to probate your father's assets. Probate cases can be filed even though there is no will. The probate judge will order the girlfriend to produce all of your father's wills that are in her possession, if you ask for that order. You should hire an attorney to file the probate case for you. I would be happy to help you, either as your lawyer, or to help you find another lawyer if your father lived too far away from Chicago for me to represent you. Call me at (630) 221-1755. Larry Stein
