Legal Question in Wills and Trusts in Missouri
My father died May 2003. He married his house keeper (25 yrs his junior) 4 months prior. He cut his 2 children out of his Will and gave his 1/2 of Trust to her. My mother died July 2000 - leaving her 2 kids her half of the Trust. Almost 5 yrs have passed - properties have been sold for over 1 yr and no settlement has occurred yet. Is there a law that is being broken here? Three lawyers involved can't seem to get this finished. We have not gotten a final accounting from the new wife STILL!

If the trust owned the properties, the benficaries of that trust are entitled to and accouting of the sale upon demand. IF the accouting is deied, suit would probably have to be filed. If yrou father owned the properties, then you may bring an action for a determiantion fo heirship, as to any specific property, to account for your (possibly 1/2 ) share. If either scenario is close to yours, you should consult direclty with counsel, to go over the specific facts of your father's situation. Many attornies offer a free or low cost initial consultation. Without specifc facts and information, we can only give you vague general advice here.
