I would start by contacting the benefits person at his former place of employment. They may not feel free to share information with you without seeing some authorization form th probate court. Or, if you are going through all of his personal papers anyway, there may be a statement showing information about the 401K and you can use that to attempt to contact the plan administrator to obtain a claim form or do whatever is necessary. If you are unable to get anywhere on your own, I would say it might be best to consult with an attorney.
