Legal Question in Wills and Trusts in Missouri
My father died five years ago. I have two sisters and a brother. My brother is the executor of the estate. My mother has told my sisters and me that she is giving us her money which consists ofchecking, savings and CDs; my brother is getting property. My sisters and I have not seen the will in which my mother states this. My mother has the checking, savings and CDs in my brother's name because he is the executor of the will. Our sister-in-law told my sisters and myself that we could just forget getting any of the money that it didn't make any difference what the will stated that savings and CDs are in our brother's name and that makes it his. Our brother is siding with his wife (they are in heavy debt). My mother also states that their are certain items in her estate that she wanted my sister and me to have. We have been told by my brother and his wife and I quote, "Just because the will says so doesn't mean that it's so. We don't want to upset our mother, but my sisters and I are very hurt with this matter.

This is a difficult and sensitive thing to discuss with a parent. But if one of you the doesn't, your brother could be right. Without seeing your mothers documents, it is impossible to guess about her estate plan. You might say to her, "brother says because he is executor if Dads, that he's got your plan set so that he will get all of your money and peppery. Would you like to have an attorney look overyour estate plan?"
