Father passed away with out a will

My father passed a way in Missouri and did not have a will. My father and step mother did have 3 farms together and both thier names are on the deed. They home is on the land that my father purchased with my mother. I am the oldest child from his first marriage. My step mother has not given anything, but has been giving everything to her sons and grandsons. She is listing her son's on everything she now owns. My father passed away the first of 2009. How can I take care of my brother and I?

You will need to petition to have a probate estate opened in the county where your father owned property. It is probably best to do it in teh county where he lived. This will cause all the devizeable property to come under the probate court's jurisdition. You may not be able to undo all of the transwfers your step mother has made, but you may be able to save some of the property.
