Father's Property

My father passed away leaving 3 children, Im the oldest at age 21, No wife. His mother has taken the vehicle belonging to my father. i have the title but it isnt in my name it is in his. With me being his legal next of kin, wouldnt i be intitled to his belongings and dispurse them the way i feel is best?

You may apply to be appointed personal representative of your late father's intestate estate. All of his children are equally entitled to yrou father's estate, if he left no spouse. However, the law assumes that you don't know about all of his kids, so you would have to make the estate public for other children, or their representatives to make aclaim against the estate. Therefore, you will nto be awarded the entire estate to divide how you choose.

If you father did not have a large estate, there are simplified ways of dispersing his estate. The Court clerks can assist you with that. If the estate is too large to qualify for a small estate, you will need to get an attorney. That attorney can answer all of your specific questions.
