Legal Question in Wills and Trusts in Missouri

Grandmothers estate and will

My grandmother recently died. She had two daughters. One is still alive and in charge of the estate. The other was my mother who died 15 years ago. I know my grandmother had a will and believe that it states that my brother and I will split my mothers half of the estate. I have not seen the will. My aunt is getting ready to auction everything and I need to find out how to proceed ASAP. How do I go about obtaining a copy of the will? My aunt has not contacted me about the auction. I found out through another relative about it. My brother and I are not on great terms with the aunt. What should my next few steps be?

Re: Grandmothers estate and will

You could check with the Probate Court in the County where your grandmother lived to see if there is a Probate Estate opened. You could then read and obtain a copy of the Will. If there has been no Probate Estate opened, you can file a Petition requiring your Aunt to respond in Court and file a Will if she has one to file. You may consider hiring an attorney to assist you.
