Legal Question in Wills and Trusts in Missouri

Homeless Man's Estate?

My 47 year old brother was murdered in St. Louis 5/18/05. He left Kansas 03/02 and had property at both a brother's and sister's homes. He left one sibling a note saying he could ''have'' anything he left and implied that with the other. The property includes several disabled vehicles and misc. odds and ends collected in his ventures as a displaced person for approximately 15 years. None of the property has any real value, some may have sentimental value to a family member.

My brother had no bank accounts, no credit cards, no real property and no outstanding bills (be may have owed the IRS some money).

Is the family required to ''probate'' the estate? He was living ''one the waterfront'' in St. Louis at the time of his death the property is in Kansas.

Re: Homeless Man's Estate?

If you or your sibling ar willing to dot the "i"s and cross the "t"s you can do a small Estate or refusal Affidavit. Go to the County where the property is located, or wherever he last had a permanent address in Kansas. This is one of the few actions in which the Clerk of the Probate Court may assist you.
