my husband passed away recently and i need to get a power of attorney to get into any bank accounts or safe deposit boxes he may have had will i need to go to probate court for this?

First, please accept our condolence on your loss.
A power of attorney can only be granted by someone living, and for most purposes dies with the person who creates the power of attorney. Based upon your brief description you will have to open a probate estate insofar as bank accounts if you are not already an owner of the account. You can also get a court order to allow you to view the contents of a bank box, but in most situations the order requires the bank to deliver the contents to the Probate Court. All in all you probably need to be retain an attorney.
