Legal Question in Wills and Trusts in Missouri

My ex husband recently passed away and he left without getting his new will signed. His previous will from 1989 has me inheiriting his estate. Does my divorce decree annul this or can i still make a claim. The executer of his will has turned things over to probate. I'm really just wanting to know if i can make a valid case or not .Thanks, Pam

Without seeing the 1989 Will, it is impossible to determine if you can make successful claim. A calim is vlaid, if it has a resoned basis. In the general case you make, and depending upon the wording of the will and yrou divorce decree, you might have vaiable and therefore valid claim to make. It would be "vaild", in that while it may fail, but would probably not get you socked with sanctions for bringing the claim. You shoudl consult direclty with a probate attorney in your area if you want to estimate your chances for a successful claim. Many attonreys off a free or low cost initial consultation.
