Legal Question in Wills and Trusts in Missouri

inheriting personal positions

My mother recently passed away withou leaving a will. My daughter's name is on her house deed so she will inherit the house. But does she automically inherit the contents of the house, do I as an only child (next of kin) inherit these things, or will the contents go to probate? I entered an area of law as requested, but I was not sure which area of law to choose.

Re: inheriting personal positions

Based on the information provided the personal property should pass to you, but a probate proceeding will theoretically be required. From a practical perspective may prove problematic in that personal property sometimes "disappears". In many cases the families simply agree how personal property will be disposed of. If there is family discord, then the probate proceeding is the way to go. You may qualify to use one of the Small Estates proceedings if you are in Missouri.

I don't know where you are located, but we do offer a "no charge" initial consultation.
