Legal Question in Wills and Trusts in Missouri
Use of lawyer specified in will
Do we have to use the same attorney that was specified in will that my parent had used to make out will ??
Also -- Is there a specified charge for the use of a probate attorney or do they vary?

Re: Use of lawyer specified in will
Generally a Personal Representative (PR) does not have to use the lawyer "suggested" in a will. The lawyer is not allowed to contest his/her not being retained by the PR.
Probate attorneys vary in theri fees. Some charge an hourly figure, and others charge a percentage of the estate. However, the Court can always assess the reasonableness of an attorney's fee.
Good Luck
