How long for probate?

My brother past away May 07. He had no will and I was the only close relative (brother). I was made executive of the estate. He had no bills but we hired an attorney that said we would have to wait 6 months for any creditors to make their claim. That time was complete in January yet our attorney still has not finalized anything. We can not get him to return our calls and there are certain things we are wanting to take care of. My brother had a home and a 401K . Is this normal that it should be taking this long or is my attorney just giving me the run around?

It is always difficult when an attorney does not return phone calls. Perhaps there is someone else in his or her office who can discuss your file with you. You may be very close to running out of time to file the papers you will need to file with the probate court, if any need to be filed at all. So, it is crucial that you find out what exactly is going on with your attorney immediately. If you can not do so, you need to fire that attorney and hire someone who will talk to you.
