Legal Question in Wills and Trusts in Missouri
Is there a maximum time alloted to disburse a will and is a will a public document?
1 Answer from Attorneys
As long as teh will is admitted to probate within a year of the decedent's death, there is nto set time for the assets to be fully distributed. Each estate is different. Soem take just afew eweeks to distribute, and some take years. If the will has been admitted to probate, it can be viewed, as can other court records) at the courthouse in the county where the estate is. If the Will is not admitted to probate within a year, it is just a piece of paper, and not a will, as far as Missouri is concenred. If the Decedent died living in another state. The laws of that state determine when a will can be admitted to probate or how it can be viewed by the public.
