Legal Question in Wills and Trusts in Missouri

Missouri Last Will & Testament

We want to name both of our sons as our Personal Representatives (Executors) of our estate on our wills? Is that legal in Missouri? Is it advisable? Also, we want to indicate on our wills that we want Independent Administration. What wording do we need to it include to make that indication?

Re: Missouri Last Will & Testament

You can name two persons to serve as co-Personal Representatives in your Will, but I would not advise it. What do you think will happen if those two people do not agree on any one of a number of issues that might arise in the handling of the Probate Estate? Are you going to provide a clause requiring arbitration in such an event? Why put them in that situation in the first place? The attorney you hire to draft your Will will know the appropriate language to provide for Independent Administration, or are you trying to do your own Will? Again, I would strongly advise you to use an attorney. Inadequately drafted Wills will cause much more trouble and expense for the people you leave behind than any savings you might realize now by not using an attonrney.
