Legal Question in Wills and Trusts in Missouri

Morality vs Legality

My father has 4 biological children, 3 with his first wife and 1 with a second wife. He also has a stepson 46 years old whose mother died in 2006. In the event of my father's death what portion of my father's estate is due to the stepchild?

Re: Morality vs Legality

Nothing goes to the stepson in this case unless he is is provided for in your father's will.

Re: Morality vs Legality

In Missouri, everything would go according to the terms of a valid Last Will and Testament if there was one. If not, if your father adopted the stepson then the stepson would inherit equally with the other children. If there was no adoption and no gift in a Will, then the stepson would inherit nothing unless there are other facts which are not included in your post.
