Legal Question in Wills and Trusts in Missouri

mother-in-law died leaving no will

My mother in law died with no will. We are 1000 dollars in the hole on her burial. The only poperty is a 1964, 10x50 mobile home. The only name on the title is hers. My husband is the only relative interested in this. Can we just sign the title on the trailer or do we really have to go through pobate. It will cost more than we can get out of the trailer. She did leave him a letter on her kitchen table, no witness, that he was to get out of the trailer what he could. Please help.

Call the County Court of the County in which the trailer is or where the decedent lived. Ask for the Probate Clerk. Tell her that your husband wishes to do a Small Estate Affidavit. This is one of the few areas where the Court personnel can assist you without you having an attorney. Fill out and file the forms. Then get the trailer retitled in decedent woman's children's names. You may get it in just son's name if you can get the others to Disclaim.

Good Luck
