Generally the Power of Attorney docuemnt needs to be accessible by those person who are to rely on it to treat the designated attorney in factas having that authority. This can be a hospital fo other health care provider, a school, bank or other business. There is seldom any court involvement unless someone contests the power of attorney designation of wishes to have it replaced by the probate court.

Normally a client comes to me and asks me to prepare a Power of Attorney. After I do so, I give the Power of Attorney to the client. If there is going to be any transfer of real estate involved, the Power of Attorney should be recorded by the County Recorder of Deeds. Usually there is no Court involvement.
