Legal Question in Wills and Trusts in Missouri

Power of Attorney

I want to know how to I go about having my name removed as one who has power of attorney. My mother ( who has advanced renal cell carcinoma, kidney cancer, stage 4) designated my younger sister and myself as power of attorney. Because of some events that have taken place I want to remove my self from having power of attorney and let my sister have full POA. How do I do that?

Re: Power of Attorney

I do not believe that it is necessary for you to do anything if you wish to renounce your authority under the power of attorney. Most powers of attorney are legal documments through which a person grants another person (or two in your case) the power to take certain actions for the person granting the power of attorney. That document itself does not usually confer any duty upon you to actually do anything, if you choose not to do so. I would suggest at a minimum that you advise your sister that you will not be taking any action pursuant to the power of attorney. If you feel the need to have this put into writing, I guess you could have a document drawn up putting everyone on notice that you will not act under the power of attorney, but I personally do not believe such a document is necessary.
