Legal Question in Wills and Trusts in Missouri

probate question

I have an estate that is currently in probate and my lawyer is not telling me anything. The only way that I find anything out is to call the probate court. The probate court has informed me today that the estate, which was supposed to be finalized this month, has been pushed back to Jan. because the lawyer has not filled the papers. He has had them since Nov. of last year. Is there anything I can do about this or do you have any advise on how to handle the lawyer.

I would suggest that you call the lawyer's office and insist upon making an appointment to meet with the lawyer face-to-face. He or she may very well be able to explain to you the reasons why the handling of the estate will require more time. My understandng from your post is that this lawyer is representing you, but if this is not the case, then my advice would be different. If you are an heir or a legatee and the attorney represents the personal representive, for instance, the attorney may not wish to meet with you. In that case, you might consider hiring an attorney to deal with the other attorney and help protect your legal interest in the probate proceedings. If the attorney is representing you, on the other hand, and refuses to meet with you or keep you advised, then you have the right to terminate the employment and hire a replacement. I would certainly view this as a last resort since it appears that this attorney has already put in at least a certain amount of time and effort, and it might be more efficient to allow the current attorney to finish the job.
