What would cause someone to have to probate a will in the State of Missouri?

When a person with a Will dies in Missouri the Will should at least be filed with te Probate Court within one year. This does not mean that the Will is being probated. Naturally, everything owned by the deceased person at the time of death should go to those people the deceased person desired as set forth in the Will. The probate laws instruct us on how the legal transer of those assets is to be accomplished. The law also provides for an opportunity for any creditors of the deceased person to make a claim for payment out of the estate assets. Depending upon the size of the estate, the value of the assets, there are several different procedues that may be followed. If you are involved with any situation in this area, you should consult with an attorney.
