A properly executed beneficiary designation will prevail. If this concerns real estate, the beneficiary deed must have been recorded prior to death. If a life insurance policy, etc. the beneficiary must be properly on file with the company.

Beneficiary form controls first if properly executed and recorded with the proper authority.
