Legal Question in Wills and Trusts in Missouri

Want to look at will my cousin allegedly left a non family member

My third cousin died on September 5, 2005. The newspaper article said he had no family. However, I am his blood third cousin. He told everyone he had no family, but I have genealogical proof of our exact blood relationship.

I called the man today who had been handling his affairs and asked him if Delbert had left a will. Terrance told me that yes, when he left the hospital, and went home he made out a will and left everything to him.

Then I called the probate court and asked them about this ''alleged'' will. they told me that if the man had a legitimate will, he should file it within a year of Delberts death. After that, the will would not be valid to the court.

A friend of mine seemed to feel that the right thing for Terrance to do would have been to tell me to come down and look at the will since I was a blood relative. Delberts estate is worth between $100,00 and $200,000 dollars. I need an attorney preferabley from the St. Louis area to handle tis for me. I don't want one from Cape as they may be afraid to take on the Nip Kelly family. Contact me by phone, or email if you have any more questions, advice, or want to take the case.

In Peace

If the deceased did leave a valid Will giving everything to this other person, then you may not inherit anything in any event. Still, you have a right to know, and an attorney might contact the person who has the Will and demand to see it. If that person is not forthcoming, there is a legal way to compel him to file the Will. I have done this here in St. Louis County. I am sure that there are many competent attorneys in your area who can and will help you. If you would like a referral you may call me at 314-727-2822.
