Legal Question in Wills and Trusts in Missouri

Will vs Trust

My grandmother wanted to redo her will when one of her children died. After she died we found out she actually had a previous trust not a will. The new will says she leaves everything to her living daughter. The trust (20 years old) splits all property between the two daughters and their heirs. She has some CD's in the name of the trust. She names the real estate in the trust but I don't think it was retitled. Sorry I know this is a little long. My question is does the trust still take precedent even though it conflicts with her last wishes? And more importantly if the house is not actually titled in the trust, who gets the real estate?

Re: Will vs Trust

An attorney would need to review all of te pertinent documents before providing any specific legal advice in your situation. I would strongly suggest taking the documents and consulting with an attorney.
