Re: Back rating

In Missouri, disability percentage ratings are based on the doctor's opinion and experience. In Kansas, ratings must be based on the AMA Guides to the Evaluation of Impairment, Fourth edition. In each scenario, the company doctor's rating may vary greatly from the opinion rendered by the injured worker's doctor. Consult an experienced workers' compensation lawyer to make sure your rights are protected.

Re: Back rating

As others may have stated, the doctor who is paid by the employer's insurance company is going to give you a very minimal rating. Your attorney will have you rated by a more objective doctor and that doctor's rating will be significantly higher. Usually your claim for permanent partial disability will be settled based upon a compromise between the two ratings. It is extremely important for you to have not only the best attorney you can find, but also for the attorney to use the best doctor he can find for the purpose of rating you. Most attorneys who practice in this field have a large number of very experienced medical professionals to choose from to assure their clients get the best possible rating and settlement or other recovery of compensation. If you do not have an attorney, you definitely need to get one. You will receive more compensation even after your attorney deducts his fee then you would receive if you go through this without an attorney. You may feel free to contact me and I will be happy to refer you to one of the very best worker's compensation attorneys in practice.

Re: Back rating

If the rating is being done by the doctor that the employer chose, you can expect it to be less than you deserve. Your attorney should discuss getting your own rating from a doctor of your choosing. If you have chosen not to use an attorney, than you should expect to get less than you deserve for your injuries and loss.

Good Luck
