The value of an injury in a worker's compensation claim is calculated according to a formula provided by statute and depends in large part upon how the injuries are "rated". The injured person's attorney will usually have the injuries "rated" by a doctor who is experienced in providing "ratings" and testimony, if necessary, for worker's compensation claimants. The employer's insurance carrier will have the injuries "rated" by a doctor who almost always works for the employer's side. As you may imagine, these "ratings"almost always vary substantially. The attorney for the claimant and the attorney for the employer most often negotiate a settlement of the conflicting "ratings" and agree upon compensation somewhere in the middle. This system can result in two different people receiving different amounts of compensation for seemingly similar injuries.
