Legal Question in Workers Comp in Missouri

need of motion to dismiss legal representative

I recently wrote a letter to my then attorney in my WC claim due to a breach in the contract. I also notified the other agencies involved. I know that either representative talk to me during the time that I was represented. But now it has been a month and still no one will return my calls. The State assistant attorney general has still refused to take my calls stating that she needs a document that releases my lawyer from me. No one ever mentioned that and I don't know if that is true and if it what do I need to do to obtain it. Any help would be appreciated. I just want to talk to someone.

Re: need of motion to dismiss legal representative

Attorneys are barred from providing advice or sometimes even discussing a case with a represented person, without theire attorney. It appears that you had (and may still have) an attorney representing you in a WC case. You privately fired that attorney, by correspondence. other attorneys have not seen that letter, and thus must still treat you as represented. If you have fired yoru attorney, then send a letter to each attorney you wish to discuss the case with, telling them that that attorney no longer represents you. You may also have to get aruling from the WC Judge allowing your attorney to Withdraw.

Keep in mind that your present or former attorney may still make a claim for their fees based upon the work they performed.

Yu had a sentence in your question about knowing that wither representative talked to you. I don't understand that, and it may change the action you should take. Therefore, i strongly suggest that you discuss your situation with an attorney that has access ot all of the facts before taking any steps, even the ones described here.

Good Luck
