If a employee has been released from the doctor for a comp claim but refuses to return to work can he be fired? Do I need to document everything to cover myself and my business. Just what is the law concerning this matter.

I have to apologize for my colleagues who are using this board to advertise their services without answering or even addressing the question that has been asked.
If the employee has been released from the doctor and is not returning to work, he may get fired. So long as the release from the doctor has not been conditional, i.e., requiring light duty, or limitation in lifting, seating etc...
Generally clearly documenting everything that has been done is a good idea. It is also a very good idea to consult an attorney and to make sure that you get an advice that is tailored to your needs and requirements.
