Legal Question in Workers Comp in Missouri

I reported to my employer about my lower back pain becoming to painful to go on on Oct 23. They asked me what was the accident. I told them tsht this had gotton worsre over time. I drive a standup forklift and my lower back over time has been damaged. They said I would have to go to my own Dr. I went to him the following day and had a MRI 3 days later. It was discoverd I have 3 bulging discs and stenosis in my lower back more prevelent to the left side which explaines the numbness in my left leg. It was obvious to my dr that the injury was work related and sent my company a letter stating that. He suggested to them that I needed immediate attention right away and sent me to PT. He also suggested that they send me to a back specialist. So far as today they still are making me use FMLA.

You may have a valid workers compensation claim. You should go to the employer's doctor to help preserve this claim. The direction of an attorney may be necessary to make this happen. Give me a call if you would like to discuss. Thanks.

Hi. I am sorry to hear about your injury. Not all work-related injuries occur as a result of a specific accident. It sounds like you have what is referred to as an "occupational disease". This is an injury that has been caused, not by one specific accident, but rather, by the total effect of continuous strain to an area of the body over time.

It appears that your employer is attempting to deny you the benefits that you are righfully entitled to under the Missouri workers' compensation statute. In instances where the employer refuses to comply with workers' comp. law, it is necessary to file a Claim for Compensation.

I am a Missouri attorney that focuses exclusively on injury cases and handles claims in most parts of the state. I do not charge any fee whatsoever up front, and the fee is simply based on a percentage of the overall amount of compensation recovered for you. In your case, the amount recovered could be substantial.

I can be reached by phone at (314) 471-5585, or, for your convenience, by e-mail at [email protected]. Also, keep in mind that there are deadlines for filing a Claim for Compensation, so do not delay. Thanks.
