Legal Question in Workers Comp in Missouri
work injury
I was injured at work last July of 04. I have long
term injury that of course the company is denying
treatment for. They have fired one company doctor
when he accused them of medical negligence for
refusing much needed testing and treatments. The
second doctor also was company denied testing and quit
with the words, ''I don't know what is wrong with you I
am just telling your company you can not do your job
and rate you on a disability.'' I have at this point
searched for my own doctors who have helped but the
personal cost is staggering. I have seen six doctors
who find injury. I hired an attorney who I believe
is not representing my best interest and often can not
recall who I am. I was scheduled for an ''emergency hearing'', but it was canceled my attorney did not secure the medical records in time. He wants me to personally retrieve them and ''light a fire under this doctor'' and do the foot work. Now the two attorney have decided between them that I should see yet another doctor the company wants. I feel like a tennis ball going back and forth over the net. I still have no assigned doctor to attend all my
injuries and strongly suggested surgery. Can you
help?

Re: work injury
I may be able to help you expedite your claim. However, I am forbidden from giving you advice about how to handle your claim, while you are represented by another attorney. It has been my experience, that the WC claim process takes much longer than most lay persons imagine. The different doctors that one must see for competing ratings and prognosis of treatments, can seem illogical, and probably is.
The bottom line is your health. The rest is just money. If you feel that your health or chances of recovery are suffering, you need to make this known to everyone involved. This is particularly so, with your doctor(s) and your attorney. If your attorney does not remember who you are when you call, let them know that you are considering firing them. If that does not get you at least a better explanation of where you are in the process, then you should consider looking for a different attorney.
Good Luck.
