If the company doctor says he would recomend surgery, do you have to have surgery to still get the benefits that you are intitled to?

That is a tricky question because there are several types of benefits available to an injured employee. You have the right to treatment at the direction of your employer. You also most likely have a right to a settlement amount. This amount may be different depending on whether or not you have the surgery. You will most likely need to retain an attorney to get a settlement amount. The employers usually do not volunteer this benefit or, if they do, it is based on an unfavorable rating that makes the settlement too low.

Do you have an attorney? If so, ask your attorney. If not, then you should consult with an attorney as soon as possible. You will not receive everything that you are entitled to under the law if you are not represented by an attorney, and you will receive more in compensation if you use the services of an attorney than you would if you try to go through this on your own.
