Legal Question in Disability Law in Montana

Surgery and length of recovery

I had surgery for carpal-tunnel syndrome performed 1/22/99 and on other hand 2/2/99. Had verbal agreement with employers relating to returning to work and getting all my shifts back upon my arrival. I missed 7 weeks of work total, 2 weeks because schedule was already made out. So actually was ready to return to work after 5 weeks. When I returned I found they gave away 2 of my shifts permanently. Is an employee allowed a certain amount of time before employers can give shifts away? Is the verbal agreement binding? Thanks for your help.

Re: Surgery and length of recovery

These cases are very fact oriented.

Go to a local discrimination lawyer and tell

him or her the whole story.

What were your damages?

Was your salary reduced?

responsibility reduced? How are you a month later? Everything restored to normal? How much money, if any, did you lose? Was a promotion affected?

Tell a lawyer everything. It's difficult to

advise you on so few facts. A lawyer is going

to want to see evidence of damages.
