Legal Question in Criminal Law in Montana
family assault personal injury
I need to ask a question about family assault. Myself and my girlfriend got into a fight this past month and she hit me with a hammer. Well, the police were called and she was taken to the station but never formally arrested. I was questioned twice, first time I said I would not press charges. 2nd yes. It's been under investigation for almost a month now and I just wanted to know is there any way that I could have the charges stopped? I don't want her to go to jail. I feel lucky to have found you guys. Thank You.

Once you invoke the system by calling the police you lose control of the case. Someone else will decide where it goes now.
You can contact the case officer and tell him of your change of heart and that you do not wish to pursue the case further, but it will be his call as to what happens next. You can also advise the DA that you don't wish to proceed.
