Misdemeanor Theft

What is the punishment for a fist time offense for misdemeanor theft. Value of theft $80.00. With no prior arrests or convictions.

A conviction for a first offense misdemeanor theft is punished by a fine of up to $1,000.00 and/or county jail time of up to 6 months. I cannot say what the usual sentence of the judge in your part of the state will do. Most never sentence to the maximum on a first offense. Second or subsequent offenses trigger greater penalties, for example, for a second conviction, the fine is $1,000.00. The fine is then no longer up to $1,000.00 but is that amount. Obviously no one wants to be convicted of a second offense. Restitution is usually ordered by the judge in any case. Good Luck!
