Legal Question in Criminal Law in Montana

Pressing charges for sexual molestation

My grandson was molested by his grandfather (my ex). This has been reported and was sent along to the detectives at our local sheriff's office. Nothing has come of it since it was referred 4 months ago. When asked, I am told that they (the detectives) are busy. Can we hire an attorney and press charges or do we have to wait on the law enforcement system to complete their investigation - if indeed, there is one ever conducted? By the way, grandson is 14, and I have custody of him. Grandfather lives and works on a 4H camp year round - nice place for a predator to be situated!

Thanks-

Contact Child Protective Services/Montana Social Services and make your complaint with them also.

Put everything in writing from this point forward.

Good luck.

Re: Pressing charges for sexual molestation

In addition to the suggestion made by Mr. Aspinwall, you, as legal guardian of your grandson could bring a civil suit on behalf of the child against this man. Bear in mind that your motives will be questioned, after all you are the ex. You may wish to consider this possibility and contact a lawyer. A civil suit usually does not move along real quickly. Good luck.
