Legal Question in Criminal Law in Montana

sex offender /spousal employment

My husband is a convicted sex offender (5 yrs. deferred)and the dept. of probation and parole has told me that I am not allowed to gain employment that has to do with children, or is related to schools. I have been told that I can not be a sales rep. to schools or youth camps. I was doing childcare for two kids in my home and have been told I can no longer do so. Does the State of Montana have the legal right to control my employment due to my husbands conviction?

I'm sure that this seems like a great imposition on you that you did nothing to deserve. I don't know anything about your husband's case, so I am going to operate under the assumption that his crime involved children. If that is the case, the State would not want you accidentally providing him with a steady supply of new victims. I cannot imagine you being able to be licensed as a day care center with a convicted sex offender living in the home. The state does regulate the day care industry to some extent and this type of regulation should not come as a surprise to you. DOC does have the power to regulate the conditions your husband lives under and that will certainly affect you.
