What is the definition of statutory rape and who can file charges?

Re: statutory rape
Statutory rape is called sexual intercourse without consent in Montana. A person under the age of consent, 16, is presumed to be unable to consent to sexual relations. The person charged must be 3 or more years older than the victim who must be less than 16 years of age. The charges are filed by the County Attorney. Hope this answers your questions.
