Tatoos for Minors?

My daughter got a tatoo, without parental permission. She is 16, residing in the state of Montana. Does the tatoo parlor have the right to give tatoos to minors without parental consent?

The statute, �45-5-623(1)(e) MCA makes it a misdemeanor offense to tattoo a child under the age of majority without the explicit in-person consent of the child's parent or guardian. It would be up to the county attorney in that county to prosecute the tattooist. You might ask for the county attorney to seek restitution which could include tattoo removal. Your child may have other ideas. I'm sure you have considered that as well. Good Luck.
