Legal Question in DUI Law in Montana

spouses liability in drunk driving

If your spouse injures or kills someone by drinking and driving, if the innocent spouse affected and if so how? For example if the victims family were to sue the drunk driver would the home and business of the drunk drivers family be at risk? I own my own business in which my alcoholic husband has no association. How can I protect myself and my business?

Spouses are not ordinarily held legally responsible for the acts of the other unless they conspire or otherwise enable them to drive drunk.

Your business will not be held responsible for your husband's acts so long as he is not associated with or working for it.

Your best protection will be a lot of insurance on the family car.
