Legal Question in Family Law in Montana

change in venue

My spouse and I divorced in the state of Montana. Since the divorce we have both moved to different states. Litigation has been ongoing now for four years. Recently, there has been a lull. Having to retain attorneys long distance has become expensive for the both of us. Is it possible to change venue. I understand that child custody and visitation changes to the state the children are living in, but what about additional monetary claims, ie.. maitanence,child support,modifications? There is nothing in the decree that states Montana will retain jurisdiction.

All 50 states have adopted some version of one of two Uniform Child Custody Acts. Under either act Montana would retain jurisdiction. If you and your ex could agree on a venue, then it is possible for your attorneys to request the Montana Court to permit the transfer.
