Legal Question in Family Law in Montana

Child living with grandmother

My 8 year old son has been living with his paternal grandmother in Montana since he was 6 months old. I was not married to his father, nor is he on the birth certificate. I have never signed any papers or given up my rights. When the grandmother took him, she said she would keep him until I got a job and ''got back on my feet'', that was 7 seven years ago. I have been married to my current husband for 4 years and we don't have kids, but want my son to come live with us now. I have talked to the grandmother about this and she says it's not the right time. She says it is up to my son. I don't know how to do this without causing a big arguement. My son's father lives about 45 miles away from me, but I haven't spoke to him for 4-5 years. Do you know how I should handle this situation?
