Legal Question in Family Law in Montana

Child support for 3 months?

I am divorced. Ex lives in another state. All 4 kids live with me, 2 in college and working part time. Youngest son wishes to visit his dad for 2-3 months next summer. Ex is disabled and wants child support for the summer. Child will be almost 17 at that time, old enough to work. Is it really possible that I could be forced to pay child support for the summer? I will still be meeting all the childs expenses here (room, clothing, etc. Thank you. kk

Re: Child support for 3 months?

It is possible but not highly probable. Dad would need to formally move the court for a modification of child support. In Montana, he would have to show a change in the child's circumstances, then he'd have to show that the change makes the present child support obligation unconscionable. A change in the child's residence is a change in the child's circumstances, a vacation is not.
