how can i get my childs father to sign his rights over if im in one state an hes in another

Your question prompts about a dozen questions about what's going on right now, is a case open with a Montana court, does father wish to relinquish, etc. You can't "get him to sign" if he isn't willing to do it. If Father is willing, Father can sign a voluntary relinquishment of parental rights document. Then document gets filed with the court that is handling the parenting case.

My original answer to this question was too brief. I should have also noted that, even if Father is willing to relinquish, the court is not likely to allow it if the child could become a "ward of the state" -- if the state would have to assume financial responsibility. However, Father could relinquish as part of a step-parent adoption because the step-father would assume parental responsibility for the child.
