Legal Question in Family Law in Montana
divorce and child support
how can i get a child support from my husband? he doesnt have an income but he recieve money from his parent. in his bank account has about $4000 now, his school tuition is about $9000. this means that he has money to pay for child support right? because his parent will give him money.
i married him on june 2007, i moved to bozeman montana with him on august 2007,at that time i was pregnant and the due date was janury 15 20008. he left me to go back to his counrty by saying that his mother has heart surgery and he has to go back to see his mother and will come back as soon as possible but it's not true. at that time i have no one, i dont know anyone around here, i was at home alone and im just 20 years old . i gave birth on jan 6, 2008 without him comimg back. i have been help from my neighbor. after all i found out that he dates another girl in his country ( i have all evidences and witness to prove that he really did.)
so what should i do now? i ve been suffer lots from past to present. now i live with my neighbor. it seems that he doesnt care about his son at all. i ask him for child support $500. he said''it's too much for baby to use eventhough he can pay for it.''his apt is $820/month but he couldnt pay $500 for his son

Re: divorce and child support
My apologies for the delay in responding to your question.
If I understand you correctly, your husband moved out of the USA. Obviously that will complicate collecting child support, but not calculating a support amount.
I suggest that you call your regional Child Support Enforcement Division (CSED) office. CSED is in the Department of Health and Human Services, in the State section of your phone book.
CSED will send an application to open a case, and some forms to provide information about you and your financial status, and your husband and his financial status. As soon as you return the forms, CSED can begin working on your case. It will take time, but you will probably be eligible for support from the baby's birth date and for help with the baby's prenatal and birth expenses.
You can also contact the closest Montana Legal Services office and ask them to help you.
